Terms and Conditions of Entry and Waiver Release and Waiver of Responsibility
1.The GangOnTheRoad Trip is not a race or a competition. There are no prizes or money for speed and no ranking is involved whatsoever.
2.You must not compete in any manner with other participants. You must not place any bets of any kind in relation to the Event. You must drive safely in accordance with all road laws in each country and with proper courtesy to all other participants and members of the public. You must not drive recklessly.
3.Your participation in the Event and any payment of the Entry Fee shall be viewed to be your acceptance of the entirety of these Terms and Conditions and the Waiver Release and Waiver of Responsibility. If you have questions regarding these Terms and Conditions and the Waiver Release and Waiver of Responsibility, or need any further assistance you should contact the Event organisers. If you do not agree with any part of these Terms and Conditions and Waiver Release and Waiver of Responsibility, you should not participate in the Event.
2. Personal Requirements
1.You must be 18 or above by June 2021 in order to participate in the Event. You must hold a current, valid and unrestricted driver’s license and a current and valid passport together with any relevant visa(s) for each country visited during the 2021 Event. It is your own responsibility to ensure you are in possession of the correct visa(s) you may require for the Event.
2.You must participate in the Event in the vehicle you stated when completing the 2021 Entry Form. You will only be able to participate in another vehicle subject to the Organiser’s consent.
3.Only the person(s) named on the 2021 Entry Form can participate in the Event.
3. Insurance Requirements
1.You must obtain and maintain appropriate insurance to cover your participation in the Event and shall provide proof of such insurance in advance of Registration Day, 10 June 2021, in a form satisfactory to the Organiser. Compulsory insurance includes, without limitation: • Third party motor liability insurance • Travel insurance (which includes medical expenses and personal liability)
2.You must disclose to your insurers that you are participating in the Event.
3.Adequate insurance is the sole responsibility of the participant.
4.During the Event, the Organisers may at limited times take control and possession of your vehicle including without limitation for the purpose of applying stickers to your vehicle, storing your vehicle, public displays.
4. Entry Fee
1.The “Entry Fee” for the Event is NET 4990 for all entrants, per vehicle containing two named entrants in the same vehicle for the full Event from Monaco to the Amalfi.
2.Any unauthorized participants in your car who are identified as not paying the correct Entry Fees will be removed from the Event.
3.Participation in the event is only confirmed once the Entry Fee has been received and confirmed by the organizer. Until such time no places are confirmed.
4.The Entry Fee into the Event does not include personal spending including without limitation, petrol, telephone bills or other expenses incurred while staying in any of the hotels or venues (including courier/postal charges relating to sending luggage and room service charges), fines of any sort, or damage caused at any venue visited.
5.The Entry Fee does not cover any of the costs associated with the Pre-Party held in Budapest, Hungary prior to the start of the Event, including, travel, accommodation, petrol or any other expense. Participation in the Pre-Party is entirely voluntary.
1.Once the Entry Fee, deposit or part payment has been paid, the Organiser shall not make any refunds of the Entry Fee or any part of it under any circumstances.
2.Should you have to withdraw from the Event you must inform the Organiser immediately.
3.The Organiser reserves the right to amend the advertised route at any point. All Entrants will be notified of any changes in writing in this instance.
4.If you are unable to participate in the Event after paying the Entry Fee or any part it, it is your responsibly to secure a replacement who can take your place on the Event. In such a case you will be required to inform the Organiser immediately. From this point, payment of the remaining Entry Fee, if applicable, will be the responsibility of the replacement Entrant.
6. Unauthorized Participants
1.Unauthorized Participants are defined as individuals who have not paid the entry fee and are therefore not recognized or accredited participants of the Event.
2.For the avoidance of doubt, a participant cannot invite an individual to participate in the Event without the Organisers knowledge, at which point they will be required to pay the Entry Fee for their participation.
3.Being a passenger in or driving a participant’s car for any part of the Event when you are not registered as a driver is considered being an unauthorized participant.
4.The Organiser also reserves the right to refuse further participation in the Event at any point if you have unauthorized participants.
1.The Entry Fee includes one hotel room at each location on the Event, from the night of the 10-16 June inclusive.
2.Hotel rooms will consist of either a double bed or twin beds for you and your co-driver to share.
3.When checking in to all hotels, a credit/debit card must be provided as a security guarantee against any and all incidental charges and any damage to the hotel property. Any such costs incurred must be paid for by you before checking out, or such costs may be automatically debited from your credit card in accordance with the individual hotels policies.
4.You must conduct yourself appropriately at all times and abide by the rules of the hotels and other venues visited during the Event.
1.All along the Event there will be additional activities. The purpose of these is for participants to socialize and share experiences from the Event. The participation in these activities is completely voluntary.
2.No participant attending will be required to consume alcoholic beverages or engage in any undesired activity.
3.Participants attending any activities should be in possession of valid identification (e.g. driver’s license or passport). Complying with dress codes is the sole responsibility of the participant and the Organizers do not assume any liability or responsibility should a participant be turned away from the venue of an evening event due to, but not limited to, inadequate personal appearance, intoxication or unsatisfactory general behavior.
4.The Organizer accepts no responsibility or liability for any damages or losses that might occur during these activities.
5.It is the sole responsibility of the participants to acquire additional insurance to cover any of these activities. More information will be shared about them before the Event.
6.You must conduct yourself appropriately at all times and abide by the rules of the venues of the activities.
8. Compliance with Laws
1.You must comply with all applicable laws and regulations of the country and/or states in which you are travelling (“Applicable Laws”), including without limitation all speed regulations, laws of the road, laws relating to the safety of your vehicle and laws relating to the possession or use of alcohol, drugs or other prohibited substances. If you breach any Applicable Laws, the Organiser reserves the right to prohibit you from participating further in the Event without giving any refund.
1.The Organiser accepts no responsibility or liability for the consequences of you being refused passage and/or entry/exit to or from any country visited as part of the Event.
2.Any additional costs incurred on the Event are your own responsibility and the Organiser reserves the right to recover any fees incurred arising out of your actions.
3.You must provide vehicle registration plates for both the front and rear of your vehicle. Failure to do so may prevent access to the country. It is your responsibility to ensure that you and your vehicle are compliant with locally applicable laws along the route. All drivers must carry their full driving license, vehicle registration documents which are relevant to the country of registration, proof of vehicle tax and insurance and any necessary certificates and/or consents for use of the vehicle on public roads within the country of registration (where relevant).
10. Intoxicating Substances
1.You must not consume alcohol while driving.
2.You must not drive under the influence of alcohol, drugs or other narcotics, or any other intoxicating substance at any time.
3.If the Organiser finds you to be under the influence of alcohol while driving or attempting to drive or under the influence of any illegal or intoxicating substances the Organiser reserves the right to prohibit you from participating further in the Event.
1.You must not drive if your ability to do so safely is in any way compromised by lack of adequate rest, illness or any other condition.
2.The participant is not allowed to bring fireworks, fire weapons or other dangerous objects with him or carry them during the event.
It is a condition of your entry to the Event that you agree to indemnify the Organiser, its directors, member of staff and consultants against any and all claims, lawsuits and causes of action whatsoever or howsoever arising and brought against the Organiser by any third party as a result of your action or participation in the Event, including without limitation, your violation of any applicable laws or regulations or your breach of these Terms and Conditions. GangOnTheRoad, its founders or members of staff accept no responsibility or liability for any consequences relating to participant’s actions orbehavior at any time during the Event. This includes, but is not limited to, being indicted, prosecuted, or prevented from continuing the Event by authorities or law enforcement. Any participant will indemnify GangOnTheRoad, its founders and staff against any and all claims, lawsuits or causes of action of any kind arising from participating in the Event brought by any third party as a result of the participants’ actions, omissions or participation. This includes, but is not limited to, the participants’ violation of any federal state, county or city laws, ordinances or regulations. Nor will GangOnTheRoad, its founders or staff be liable for any consequences due to any participant’s breach of any terms and conditions contained herein.
13. Vis Major
1.The Organiser, its directors, and members of staff are not responsible if they cannot fulfill their obligations resulting from this contract (including without limit the holding of the Event or any part of it) in cases of fire, earthquake, epidemic diseases announced by WHO, cyclone, flood, aridity, strike, lightning, war in the country, revolution, civil war, terrorist activities and similar troubles, blockade, embargo, confiscation and expropriation, and in other cases defined as Vis Major by any applicable laws and regulations.
2.The Organiser cannot be held responsible if it is not possible for it to fulfill any one of its obligations or if a delay occurs in fulfilling its obligations due to any reason or situation beyond its will power and control, including but not limited to incidents arising from the operations of law enforcement in any territory, the general instructions of any relevant official institution, provisions of law, regulation and statute, instructions given by authorised officials, extraordinary situations, and other vis major events. For the avoidance of doubt, if the Organiser acting reasonably decides to call off the Event either before the Event or during the Event due to an incident (such as a death or serious injury in connection with the Event, or an event that otherwise naturally detracts from the Event), such event will be considered to be a vis major event in accordance with this Clause and the Organiser will have no liability, in particular and without limitation, to refund the Entry fee or any part of it to any participant.
1.You agree to have the 2021 official GangOnTheRoad sticker pack attached to your vehicle and to maintain them on your vehicle during the entire Event.
2.Stickers are not permanent and easily removable without damaging vehicle finishes. The Organiser will therefore not be responsible for claims for damage to vehicle finishes as a result of the application or removal of such stickers.
3.Personal sponsorship with regard to the participation is only permitted with the prior written consent of the Organiser.
15. Refusal of Participation
1.The Organiser reserves the right to refuse your entry or participation prior to and during the Event at any time and for any reason whatsoever (without being obliged to disclose the reason).
2.In case of the cancellation of the Event or the refusal to allow you to participate further, no refund of the Entry fee will be made.
3.If you violate any of the above terms and conditions or refuse to follow the instructions given to you during the Event by the Organiser or any of its member of staff, you may be prohibited from further participation in the Event.
17. Personal Filming
1.You are entitled to take photographs and film footage of your participation in the Event for non-commercial purposes only.
2.You are not entitled to reproduce or use photographs or footage of the Event on any website, printed media, television programme or any media for a commercial purpose without obtaining the prior written consent of the Organiser.
16. Image Rights
1.By participating in the Event you consent to be photographed and to be included in the filming of the Event.
2.You release the Organiser, its founders, directors, and member of staff from and against any and all claims which you have or may have for invasion of privacy, defamation or any other cause caused by directly or indirectly of the production, distribution, broadcast or exhibition of photographs or footage of the Event.
3.You hereby waive any and all rights of publicity or privacy and grant the Organiser a royalty free license to use and exploit your appearance in the Event in any and all manner and media throughout the world in perpetuity.
18. Change of Terms
1.The Organiser reserves the right to change these terms and conditions from time to time subject to notifying you of the changes.
2.You shall be deemed to have accepted the amended terms and conditions by participating in the Event.
You agree to keep confidential, and not disclose to any third party, details of any incidents that occurduring the Event including, without limitation any and all details of any road traffic accidents that may occur during the Event.
At the organizers discretion, a pre-party is going to be held in Budapest, Hungary prior to the start of the Event in order for participants to get to know to each other. It is a private event and participation is entirely voluntary. The entirety of this Agreement also applies to the pre-party. The Entry Fee does not cover any of the costs associated with the Pre-Party.
Waiver Release and Waiver of Responsibility
1.Acknowledgement of Risks Related to Participation
I acknowledge and realize that participation in the 2020 GangOnTheRoad Trip is potentially dangerous and that there are several risks associated with my participation. Such risks and dangers include, but are not limited to collisions, traffic accidents, collisions with pedestrians, vehicles, other drivers, and/or fixed or moving objects, and the negligence of other drivers. I fully understand and realize that my participation in the Event might result in serious bodily injury and/or death to myself, or others. I further realize and understand that the route of the Event will require driving on public roadways upon which the hazards of traveling are to be expected. Further, I realize that participation in the Event will require serious physical exertion, as participants will be required to drive for long periods of time over several days, including the risk of driving through stern weather. With full knowledge and understanding of the risks associated with my participation in the Event, I enter the Event voluntarily and fully accept and assume every such risk for loss, damage, or injury (including death).
3. Compliance with Terms and Conditions
I agree to comply with all the Event’s terms and conditions of entry.
4. Release of Liability
In consideration for being allowed to participate in the Event, I hereby waive, release, and forever discharge, for myself, my heirs, executors, administrators and legal representatives, any and all rights and/or claims which I have, may have, or may hereafter accrue to me against the Organiser, its officers,directors, employees, agents and member of staff for any and all damages, injuries (including death), and/or claims which may be sustained by me or my vehicle directly or indirectly arising out of my participation in the Event, even if the damages, injuries (including death), or claims are caused by the negligence of any of those persons listed above. Further, I agree not to sue the Organiser, its officers, directors, employees, agents and member of staff for any and all damages, injuries (including death), or claims which may be sustained by me directly or indirectly arising out of my participation in the Event.
This release and discharge includes, but is not limited to, property damage, economic loss, claims for personal injury, death, breach of contract, contribution indemnity, indemnity, punitive damages, negligence, or any other legally recognisable claim arising out of my participation in the Event (including all legal costs associated with such claims).
I hereby agree to release, defend, indemnify, and hold harmless the Organiser, its officers, directors, employees, agents and member of staff of the Event from and against any and all claims, demands, damages, suits, liabilities or actions arising directly or indirectly out of my actions or otherwise from my participation in the Event whether made or claimed during or after the Event, including all associatedcosts and expenses and any amounts which the Organiser may pay as a settlement or compromise of any such claims or liabilities. I have read this waiver, fully understand its terms, and understand that I have given up substantial rights by signing it. I have done so freely and without inducement or coercion. I intend this waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree that, if any portion of this waiver is held to be invalid, the balance of the waiver shall continue in full effect. Please note that by completing the entry form and accepting these terms and conditions you are concluding a legally binding agreement with us to participate in the Event on these terms and conditions. By signing below, you accept and acknowledge that:
1.you have read and fully understand the 2021 Terms and Conditions;
2.you agree and abide to the 2021 Terms and Conditions contained within this Agreement;
3.you have read, fully understand and accept the 2021 terms of the Waiver;
4.you acknowledge and accept that you have had the opportunity to get legal advice prior to signing this Agreement
